State Regulatory Offices For Tanning Currently, over half of the states across the country have established local rules and standards with regard to indoor tanning regulations. For a summary of each states regulatory position on indoor tanning, please visit our state regulatory page.
Food And Drug Administration (Federal Rules Page) The Food and Drug Administration (FDA) sets standards and rules for the manufacturing and labeling of sunlamp products in all states. A "sunlamp product" is defined as any electronic product designed to incorporate one or more ultraviolet lamps and intended for irradiation of any part of the living human body, by ultraviolet radiation with wavelengths in air between 200 and 400 nanometers, to induce skin tanning.
Federal Trade Commission As a general rule, the Federal Trade Commission (FTC) regulates advertising of indoor tanning services. The FTC looks at an ad from the point of view of the "reasonable consumer"--the typical person looking at the ad. Rather than focusing on certain words, the FTC looks at the ad in context--words, phrases, and pictures--to determine what it conveys to consumers. Generally speaking, tanning salons cannot advertise healthful benefits of indoor tanning.
